How many days notice do I need to give if I am moving and need to give notice to the person who rents from me?

I rent to someone who is not on the lease and am moving because of having to live in an hostile and uncooperative environment. I want to wait until his check clears, around the 5th and then give him a written notice to vacate by the first. He will probably still drag it out until the 3rd without paying. I live in the State of California which is the day before I plan to clean up after having moved. Will this method suffice? And if not, what are the risks for adverse legal and civil repercussions? TY
